Belmonte Mezzagno: Cga returns firearms permit to relative of mobsters: “Does not associate with them”

The Administrative Justice Council has returned the firearms permit to a man from Belmonte Mezzagno (Palermo) that had been revoked because he was related to mafiosi. The decision was made by the prefecture of Palermo and the 60-year-old man had challenged it at the Tar and then on appeal: the withdrawal of the license to hold a hunting rifle and related ammunition was based on a report from the Palermo provincial command of the Carabinieri, which highlighted the lack of relations between the man and his mafia-related relatives.

In the appeal, lawyers Girolamo Rubino and Daniele Piazza emphasized, in support of the illegitimacy of the weapons ban, the absence of cohabitation or direct socialization between the man and his relatives. Furthermore, they pointed out the lack of investigative activity and the lack of reasoning.

The Cga has therefore established that “the mere relationship of kinship or affinity with a convicted individual, but not a cohabitant, is not, in itself and in the absence of additional elements, indicative of an ability to abuse firearms, with the administration having to assess and weigh the impact of these circumstances on the reliability judgment regarding the possession of firearms.”
