Sicily Region condemned to compensate a former Pip worker
The labor judge of the court of Palermo has sentenced the Sicilian Region to compensate the heirs of a worker – who passed away in 2019 – involved in projects for the recovery of former prisoners, former drug addicts, and at-risk individuals, included in the so-called “Emergency Palermo” or former Pip basin, with reference to professional insertion plans.
The man, G.T. his initials, had been excluded for lack of morality and good conduct requirements: he had indeed committed crimes in May 2005 and his presence in the basin had become incompatible, due to the approval of regional law 9/2013, which excluded those who had committed “actions contrary to public order and / or to property and / or to people”.
Despite his protests, G.T. had remained outside until another Sicilian law, 8/2017, clarified that the exclusion applied only to acts committed “subsequent to the date of entry into force of regional law 9/2013”. In July 2017 G.T. was thus reinstated in Emergency Palermo, but nothing had been decided about the three years of exclusion. The cause was then initiated by the daughters in 2022, with the sponsorship of lawyers Girolamo Rubino and Giuseppe Gatto: the exclusion between May 2014 and September 2017, the court decided, was to be considered illegitimate. The regional Labor department was sentenced to pay the amount (about 35 thousand euros) of the income support allowance that would have been due to G.T.
