Maccalube tragedy: no culprit found in death of two brothers engulfed in mud

The Palermo Court of Appeal, presided over by Michele Calvisi, acquitted all the defendants in the case of the death of the two siblings Carmelo and Laura Mulone, aged 9 and 7, in the Maccalube nature reserve of Aragona. The then director of the reserve, Domenico Fontana, and former president of Legambiente (sentenced to 6 years in first instance) and the reserve operator, Daniele Gucciardo (sentenced to 5 years and 3 months in first instance), were acquitted. The acquittal of the Region official, Francesco Gendusa, assisted by lawyers Pasquale Contorno, Giuseppe Immordino, and Nicolò Grillo, and of Giulio Vasaturo and Daniele Ciancimino, defended by lawyer Vincenzo Lo Re, was confirmed. Legambiente, the managing body of the reserve, also bears no civil liability, assisted by lawyers Fausto Amato and Marco Manno. According to the defense lawyers, it was other individuals and not the defendants who were responsible for the tragic death of the two siblings.
On September 27, 2014, the two siblings were swept away by a mudslide while out for a walk with their father. The condemning to pay damages is also overturned. Legambiente Sicilia had just yesterday signed a settlement with the parents of the two children. In case of conviction or acquittal, they would have paid the attorneys’ fees of the civil party.
