Driver reinstated by judge after being fired by AMAT, despite not having necessary diploma

The labor judge of Palermo, with a sentence last April, accepted an appeal filed by an employee of Amat, who had been dismissed because, after hiring, and after the six-month probation period, the lack of a high school diploma was discovered, a requirement specified in the competition announcement in which the appellant had participated. The appellant was represented by the lawyer Nadia Spallitta.

The judge confirmed the substantial illegitimacy of clauses in competition announcements, even those of companies owned by the Municipality, which provide for exclusion under penalty of non-essential requirements for access to that type of qualification. In particular, since the high school diploma is not an essential requirement for access to the role of driver (operating operator), the judge ordered reinstatement in the workplace and condemned the company to pay the salaries earned during the dismissal period and legal expenses.
