Driver from Casteldaccia acquitted of manslaughter charges: SUV’s wheel did not crush elderly woman’s leg.

The court of Termini Imerese acquitted a 67-year-old man from Casteldaccia, accused of vehicular manslaughter. According to the accusation, the driver in February 2018 while driving an SUV in the village, hit an elderly woman, causing her to fall and crushing her leg with the rear wheel. The woman, who suffered a serious fracture, died two months after being hospitalized at Buccheri La Ferla hospital. The woman had accused the man of causing her fall, as confirmed by an eyewitness, during her hospitalization. The medical legal consultant appointed by the prosecutor allegedly confirmed the victim’s account and the compatibility between the leg fracture caused by the accident and the fact that the impact with the car caused her death. Pending the trial, the defendant’s insurance company, despite his denial of responsibility, voluntarily compensated the woman’s family who had filed a civil suit.

During the trial, the driver’s lawyer, Francesco Paolo Sanfilippo, demonstrated through consulting that the eyewitness indicated by the prosecution could not have seen the exact dynamics of the accident from his position. His statements were completely unreliable. With a medical-legal consultation by Professor Paolo Procaccianti, it was shown that the SUV’s wheel could not have crushed the elderly woman’s leg, as the injuries would have been much more severe, and that the woman’s death occurred due to reasons independent of the accident. In fact, the woman suffered from a severe form of heart failure, which was the real cause of death. The court accepted the defense’s arguments and acquitted the man because the fact did not exist.
