Agrigento court orders INAIL to compensate farmer

The Tar of Palermo has accepted the appeal of a farmer who was excluded from a funding by Inail due to an error in the application. In March 2021, Inail had started a procedure to grant funding to agricultural businesses for the purchase of new machinery and equipment with innovative solutions to reduce polluting emissions. The funding was set at 50% of the eligible expenses for young farmers (also organized in corporate form) and 40% for most micro and small businesses. P.G., a 28-year-old from Naro (Agrigento), the legal representative of the family farm, had participated in the call, requesting admission with a financing request equal to 50%. In August 2021, Inail had authorized the funding, but in January 2022, it communicated the reduction from 50% to 40% – as Mr. P.G.’s company could not be categorized as belonging to the “young farmers” axis, where the majority of the capital must be provided by individuals under the age of forty. P.G., represented and defended by lawyers Girolamo Rubino and Giuseppe Gatto, had filed an appeal to the Tar of Palermo in April 2022, requesting the annulment of the exclusionary measure, highlighting its illegitimacy on various grounds. In particular, according to lawyers Rubino and Gatto, “the application error made by Mr. P.G. should have been easily correctable within Inail’s verification of applications. This is because the two funding lines (50% and 40%) were part of a single financing procedure, where the qualification of a young farmer would only affect the amount of funding and not the admissibility of the applications.”
