First: Yes to the stabilization of Covid workers in Nissen, from the Tar

The Sicily Palermo Regional Administrative Court, fourth section, has deemed the reasons for the appeal promoted by the Cgil Public Function of Caltanissetta, represented by lawyers Pietro Vizzini and Nadia Spallitta, in support of the many workers, socio-health operators, used by the Asp of Caltanissetta during the Covid emergency and subsequently, with repeated fixed-term contracts, to which access to stabilization had been denied.

In particular, the claimants had participated in a public selection based on qualifications in 2023, for the purpose of stabilization according to article 1 paragraph 268 of Law No. 234 of December 30, 2021, and had been successfully placed in the ranking list, in relation to the positions advertised by the company, vacant and available. However, Asp Caltanissetta did not include the winners in the workforce but, with a belated annulment measure, contested because deemed illegal by the workers, in 2024, it revoked the acts of the stabilization procedure and announced a new selection procedure, without any real public interest reason that could justify this behavior.

Now the Palermo Administrative Court, with an order dated October 14, 2024, questions the choices of Asp of Caltanissetta and states that “the appeal appears, at first glance, supported by possible elements of fumus boni iuris and considers that the issue concerning the motivations for exercising self-regulation deserves further investigation, as well as the extension of the effects of this administrative activity, scheduling the main hearing for January 14, 2025.” “We consider this a step forward – declares Monica Genovese, regional secretary of Fp Cgil Sicily and acting secretary of Fp Cgil Caltanissetta -. The administrative court, although on a provisional basis, has deemed the reasons of the workers supporting this dispute for the stabilization of health personnel to be valid. We have also requested a meeting at the regional Health Department to address the issue and provide answers to the workers.”
