Asp of Agrigento sentenced to pay one million for perforated intestine death

The Provincial Health Agency of Agrigento has been sentenced to compensate the family of a patient who died following a surgical procedure in which his intestines were perforated by mistake. The patient, a 75-year-old man, was admitted to the urology department of the San Giovanni di Dio hospital in Agrigento in 2018 to remove a bladder neoplasm.

During the surgical procedure, a perforation of the rectum and intestines occurred, which the healthcare professionals, although the complication was a known risk of the procedure, realized too late, causing peritonitis. Following the death, the family, who had followed every stage of the hospitalization for what was described as a routine procedure, not convinced of the doctors’ good performance, with the assistance of lawyer Angelo Farruggia, initiated a civil lawsuit against the Asp of Agrigento to obtain compensation for moral damages. After a long legal process, based on the contents of the medical-legal expertise ordered during the case, which also highlighted “the inadequacy of the antithrombotic prophylaxis practiced on the patient,” the court of Agrigento sentenced the Asp to compensate for the non-economic damages amounted to 927,000 euros, plus legal interest.
