Agrigento municipality condemned for changing land use area
The Palazzo dei Giganti will have to refund the concession fees that two companies had paid for the construction of two buildings that were never built. This was decided by the Council of Administrative Justice of the Sicilian Region, which rejected the appeal of the Municipality of Agrigento against the judgment of the Sicilian Regional Administrative Court and ordered it to pay the sum of 135,000 euros in favor of the companies U.C. Srl and Cpt srl.
The two companies, after obtaining the necessary permits for the construction of the two industrial buildings, were unable to complete the first one nor start the second one, as the Municipality of Agrigento had meanwhile changed the zoning of the area where the construction was planned. Following a lawsuit filed with the Regional Administrative Court, with the defense of lawyer Arnaldo Faro, the two companies obtained a judgment against the Municipality of Agrigento for the payment of 135,000 euros, plus legal interest and reimbursement of legal costs.
The decision was appealed to the Administrative Justice Council, which, however, rejected the appeal, and therefore the Municipality of Agrigento will be forced to pay, under penalty of forced execution.
