Sicily returns to the orange zone, here is who changes color and what happens after April 20

From today 6 April the regions change color and Italy will be all in the red and orange zone. Eleven regions will be in the orange zone and nine in the red zone, while Mario Draghi’s government is working on a possible, gradual reopening starting from April 20 where the numbers of the epidemic will be improving.

The control room of the coronavirus emergency and the data processed weekly by the Istituto Superiore di Sanità and the Regions will eventually bring the territories out of the areas with greater restrictions. With an apostille: based on the law decree n. 44 1st April 2021 any reopening is conditional on 1) “the progress of the epidemic” and the “implementation of the vaccine plan”, but without defining the particular criteria for deciding them. There is no specific indication. Then an exemption is given to the Council of Ministers on the basis of an indeterminate formula. And there is the risk of encountering the same hierarchy problems of the sources that led to the abandonment of the Dpcm as the preferred legislative instrument of the emergency, given that a resolution of the CDM does not have the same value as a decree law.

That said, the Draghi government has ordered with the dpcm March 2, 2021, the decree-law of March 13, 2021, n. 30 and the decree-law of 1 April 2021, n.44, the application of further restrictive measures for the containment of the contagion from Covid-19. From 6 to 30 April 2021 in all yellow areas the provisions envisaged for the orange areas apply (article 1, paragraph 1, of the decree-law of March 13, 2021, n. 30, and article 1, paragraph 2, of the decree- law 1 April 2021, n. 44). On the basis of these provisions and the orders of the Minister of Health, from Tuesday 6 April, the envisaged measures will apply:

  • for the orange zone to the regions of Abruzzo, Basilicata, Lazio, Liguria, Marche, Molise, Sardinia, Sicily, Umbria and Veneto and to the autonomous provinces of Bolzano and Trento;
  • for the red zone to the regions of Calabria, Campania, Emilia-Romagna, Friuli-Venezia Giulia, Lombardy, Piedmont, Puglia, Tuscany and Valle d’Aosta.

After April 20, the provision that could bring the regions into the yellow or white zone should be contained in a resolution that must then have the final approval from the Council of Ministers. The goal is to schedule dates and determine if and who will be able to raise the shutters. The governors, who will also see Minister Mariastella Gelmini at the State-Regions Conference, ask to “provide perspectives to those closed sectors by evaluating openings immediately after April 20, in the event of an improvement in epidemiological data, to then allow the restart of activities that have been on standby for too long, such as gyms “.

April 6: orange and red zone in the regions, what changes?

According to the Draghi decree, therefore, from 6 April the orange and red zone has been in force in the regions. What changes? In the red zone:

  • the movements are allowed only for reasons of work, health, necessity and these include assistance to a non self-sufficient person; you can return to your residence, domicile or home where you usually meet with your partner and also in second homes; you can go shopping and mass as well as the pharmacy and tobacconist’s;
  • you will not be able to go to other people’s homes; reunification with partners living in another province is allowed. There remains the possibility to go to your second home, even if you move or go to a region in the red zone (unless it is explicitly forbidden in that region);
  • bars and restaurants are closed; only home delivery service or take-away is allowed by 10pm. Autogrills along the motorways and bars in stations and airports remain open;
  • “non-essential” shops remain closed: until April 30, pharmacies, tobacconists, newsstands and other points of sale such as IT and underwear shops, as well as perfumeries will be open; hairdressers, barbers and all beauty centers;
  • The shops open are: supermarkets, groceries, hairdressers, barbers, tobacconists, pharmacies, parapharmacies, bookstores, newsagents, flower shops, toy and sportswear shops, tobacconists and hardware stores, laundries and pet shops;
  • basic sports activities can only be carried out near your home, from 5 to 22, individually and outdoors, maintaining an interpersonal distance of two meters.

In all these cases, self-certification will still be required to move. In the self-declaration form – available on the website of the Ministry of the Interior – the signatory must declare that his / her movement is determined by:

  • work needs;
  • health reasons;
  • other reasons admitted by the regulations in force or by the aforementioned decrees, ordinances and other measures that define the measures to prevent the spread of the infection;

It will also be necessary to indicate in the self-certification form: your usual domicile, a valid telephone contact, that you are not subjected to the quarantine measure or that you have not tested positive for Covid-19 (without prejudice to the movements ordered by the health authorities), to be “aware of the penal consequences envisaged in the event of false declarations to a public official” regulated by article 495 of the Code of Criminal Procedure. In the orange zone instead:

  • it is forbidden to circulate from 10pm to 5am unless proven reasons of work, health or urgency and necessity, to be proven by self-certification;
  • movement from one municipality to another and from one region to another is prohibited;
  • you can move freely and without the obligation of self-certification within your municipality;
  • you can use the derogation to visit friends and relatives in the municipality once a day: you can travel in two people (with children under 14 in tow);
  • the shops are open, the bars and restaurants are closed.

In the orange zone, walks, bike rides and runs can range over the entire municipal area and can also be done in picnic areas and public parks. Individual non-contact and outdoor sports such as tennis, golf, padel are allowed. Even with the orange color, the gyms and swimming pools remain closed. It is allowed to reach public and private sports centers and clubs in one’s own municipality or, in the absence of these structures, in another municipality in the same region.

The reopening from April 20 or from 26?

Meanwhile, the Regions would like to reopen bars and restaurants but also hairdressers and museums in the red zone. And they find a side in the leader of the Lega Matteo Salvini, who pushes for the reopening together with Forza Italia. As well as the Deputy Minister of Health, Pierpaolo Sileri, who however, cautiously, for the moment postpones everything to next month: “in May many regions will be yellow and some will be white”, he says. But “from mid-April we should see a gradual decline in hospitalizations”.

The data of the latest bulletin of the Civil Protection speak of 10,680 new infections in the last 24 hours. On the other hand, there are 296 victims in one day while the positivity rate rises to 10.4%. There are 3,737 patients admitted to intensive care, an increase of 34 units compared to yesterday in the daily balance between entries and exits. Not just commercial activities. In those territories where possible openings could be planned, one of the hypotheses is that of arranging at the same time the return to high school in the presence of 100%, based on the improvement of epidemiological data. At the moment the new decree provides for the didactic activity in presence also in the red zone up to the sixth grade and Dad from the seventh grade to high school. In the orange zone, for the latter, the return between the banks is expected to be 50%.

On the other hand, the squeeze on travel abroad has been extended to 30 April: those who return to Italy must continue to undergo a tampon, undergo health surveillance and fiduciary isolation for five days and at the end of isolation carry out another test. In Europe it will still be possible to travel without specific reasons as well as – from 7 April – also in Austria, Israel, the United Kingdom and Northern Ireland.

Meanwhile, the Corriere della Sera writes today that Palazzo Chigi last night specified that the Goyerno-Cts control room will be convened “to evaluate possible reopenings” only “on the basis of” epidemiological data processed weekly by the Higher Institute of Health (Iss), by the Ministry of Health and from the Regions. Measures and times will be established depending on how the spread of the infection will go. For now, therefore, a real turning point has not yet been set.

And Repubblica anticipates that the real date for the reopening could be Monday 26. But only with these conditions: Rt below 1, intensive care and ordinary wards below security levels and above all the population over 70 years made safe. This, according to the newspaper, is the scenario that could convince the government to sign a waiver that provides for the first reopening: bars and restaurants for lunch (perhaps with a reduced opening time until 4 pm).
