The Tax Court of Enna in Italy has accepted the appeal filed by lawyers Valentina Castellucci and Michele Cimino and canceled a reassessment notice of over 100,000 euros issued by the Revenue Agency against an agent who allegedly collected sports bets through websites not connected to the national totalizer of the customs and monopolies agency. The notice was based on a tax audit conducted by the Finance Guard for the years 2015-2018, which revealed an alleged illegal parallel betting operation carried out by Oia Service Limited throughout the country. The court annulled the notice and condemned the Revenue Agency to pay the litigation costs, stating that the reassessment notice was based on findings by the finance officers without considering the documentation provided by the alleged agent, who had signed a collaboration contract with Oia Service Ltd only in May 2019. The court determined that the collaboration was legally operated and invoiced. The judges also noted that the petitioner started their agent activity in 2019 and not in 2015, and no agreement signed for that year had been filed as evidence. As a result, the court concluded that no tax evasion or false declarations could be attributed to the petitioner, as no business activity was demonstrated for the disputed period in the tax year 2015.
