Retrial required for Mauro Glorioso’s injury case after bike falls from Murazzi in Turin

No extenuating circumstances for the injury of Mauro Glorioso, the student from Palermo hit by a heavy bicycle dropped from the top of the Murazzi del Po embankment in Turin in January 2023. The Court of Cassation has annulled and referred back the sentence by which a judge of the court, in first instance, at the end of an expedited trial had imposed 10 years and 8 months for attempted murder on one of the defendants.
The reasons are not known but the ruling explicitly refers to an annulment “related to the granting of generic mitigating circumstances”. Now Victor Ulinici, a nineteen-year-old accused of being part of the group of launchers, faces a new hearing before a preliminary investigating judge.
The young man, who during the trial had apologized for what had happened, had been granted mitigating circumstances equivalent to aggravating circumstances. The possibility that the Cassation Court should find them “prevailing” (thus with a lower sentence) is considered unlikely in the legal circles also because the prosecutor had requested 14 years of imprisonment and the attorney general, who had filed an appeal to the Supreme Court, had moved in the same direction.
“This – commented the defense lawyer, Luigi Tartaglino – is truly an exceptional case. We are talking about a clean record teenager who was just over eighteen at the time of the incident. In a few weeks, we will be able to read the content of the Court’s ruling and know more.”
When Mauro was hit by the bicycle, he was in line with his friends waiting to enter a nightclub. The injuries he sustained were very serious and he still suffers the consequences today. The alleged perpetrators of the throw were identified and arrested by the police some time later. The legal proceedings followed different paths.
Three minors have already been sentenced on appeal to 9 years and 6 months, 9 years and 4 months, 6 years and 8 months of imprisonment. For a fourth defendant, an adult, the trial will resume in court tomorrow. In the courtroom, at the hearing on September 30th, Mauro’s friends appeared: “I clearly saw a bicycle in mid-air – one of them recounted – then I felt a blow to my left shoulder, without feeling any pain. Then there was a thud. Mauro, standing, looked me straight in the eyes: but his, eyes, were crossed. A moment later, he was on the ground”.
