Palermo’s Reset board splits on managerial appointments for three officials
There is a war going on within Reset, the consortium responsible for maintenance and green care in Palermo. The board of directors is split, with vice president Paola D’Arpa on one side and president Fabrizio Pandolfo and councilor Michele Pivetti on the other. The situation has escalated to the point where legal action is being taken. In January, a court hearing will take place after the vice president requested the annulment of a board resolution from last May that delegated managerial responsibilities to three officials. D’Arpa claims that these appointments were irregular and should be invalidated. The previous administrator had appointed these officials for a six-month term, which was later extended for another six months by the supervisory board. According to D’Arpa, this was the only option until a new director general could be identified. However, instead of initiating the process to find a new director, they continued with the extensions, even with the vice president opposing it. The last appointment was made without a specified end date, but rather linked to the completion of certain conditions required for the appointment of a director general, causing suspicions that these temporary officials may acquire rights that can be pursued legally. The concern is that the Court of Auditors may hold accountable those who decided to proceed in this manner, despite receiving a valid legal opinion supporting their actions. The president claims that no one was officially appointed and that they ensured the functionality of the company by retaining the existing officials. There is a worry that the Court of Auditors may involve those who decided to proceed in this way, even though they had the support of Professor Massimiliano Marinelli, an authority in labor law. The official correspondence from the Office of Analogous Control, led by Roberto Giacomo Pulizzi, states that these appointments and extensions were authorized and executed in violation of a law from 2001, without prior authorization and control from the municipal administration. Pandolfo remains calm, stating that they have acted in the best interests of the company, following procedures and the law, and avoiding the identification of other internal professionals to prevent increased claims. He also notes that they have not shown favoritism as they have maintained the existing positions. However, Pandolfo acknowledges that they will abide by the court’s decision and if they are found to be wrong, the municipality must instruct them on how to proceed with Reset.
