The Palermo Administrative Court suspended the warning issued by the Agrigento Police Chief against Mr. R.M., deeming the accusations of stalking unfounded. The measure, dating back to April 3, 2024, was issued based on a report from the carabinieri and some medical certifications presented by the alleged victim, who reported an assault. R.M., assisted by lawyers Girolamo Rubino and Daniele Piazza, contested the police chief’s decision, pointing out the lack of a mandatory preliminary hearing and the absence of grounds for a stalking charge. The lawyers requested the suspension of the warning, highlighting the serious prejudice suffered by their client. The Administrative Court, in an order dated September 6, 2024, requested the acquisition of the carabinieri’s notes to evaluate the suspension request. Following the hearing on September 26, the court accepted the appeal, ruling that R.M.’s behavior did not fall under the stalking offense. Additionally, the damage caused by the warning was recognized, impacting constitutionally protected rights.
