The Administrative Court has suspended only one provision of the municipality of Palermo’s regulation on nightlife and not the entire measure. The provision concerns the hours during which gaming machines with cash prizes, mostly slot machines, can be operated. The clarification comes from the municipal councilor for productive activities, Giuliano Forzinetti. At first it was believed that the entire regulation had been suspended.
The Administrative Court has accepted the appeal of a company operating in the sector. The appeal complains of the prejudice that the new regulation brings to the economic activity, with the risk of having to reduce staff. The hearing for consideration in the Council Chamber is scheduled for Thursday 11 April.
“With regard to the suspension of the nightlife regulation by the Administrative Court – as stated in a statement released by Forzinetti – it should be noted that the measure, pending the hearing for consideration in the Council Chamber, concerns only the second paragraph of article 5, relating to the opening and closing hours of gaming machines with cash prizes. However, we remain calm and confident in the pronouncement of the Council Chamber, as the initiatives provided for in the nightlife regulation were adopted to combat the phenomenon of gambling addiction and their legitimacy of action has already been supported by other court decisions.”
According to the councilor, “the nightlife regulation will withstand scrutiny by the administrative judges and, in the worst case scenario, the specific aspects concerning betting shops will be regulated by a specific ordinance. The Council of State and numerous other judgments have already supported the legitimacy of municipal administrations’ actions regarding reducing opening hours as a way to combat gambling addiction. We are confident that the structure of our regulation will be confirmed.”
