The prefect of Palermo Maria Teresa Cucinotta suspended the mayor of Giardinello Antonino De Luca. The provision was adopted in the light of the provision of the investigating judge of Palermo Cristina Lo Bue which imposed a ban on the mayor of residence in the municipality. The mayor is involved in an investigation for corruption together with the former marshal of the Guardia di Finanza Giuseppe Ciuro and a municipal employee of Montelepre who are also joined by the no-residence provision.
The suspects are accused in various capacities of the crimes of corruption for the exercise of the function, material and ideological falsehood committed by public officials, ideological falsehood committed by a private individual in a public deed and aggravated fraud against the State. The carabinieri of the Partinico company carried out the order issued by the investigating judge, by delegation from the Palermo prosecutor’s office led by Maurizio De Lucia. For the mayor and the municipal employee, the residence ban in the municipality of residence was triggered, while for the former financier, the residence ban in the entire province.
An agent of the municipal police of the municipality of Giardinello is also involved in the investigation who, however, did not have any precautionary measures. The investigation was launched in January 2020. Thanks to the interceptions, anomalies were found in the process of an administrative practice which, for the prosecutors, would have been managed according to clientelistic logic and far from the pursuit of the public interest. There are two episodes that ended up at the center of the investigation. In the first, the mayor of Giardinello allegedly instigated the municipal police officer to draw up a false assessment report for registration, to ensure that an acquaintance of his, a former financier and definitively convicted of crimes of aggravated aiding and abetting in favor of the mafia association and disclosure of official secrecy, a request addressed to the surveillance office of the court of Palermo to obtain the remission of a judicial debt for over 200,000 euros was accepted.
The former financier, recipient of the residence ban in the entire province, would have produced a false certificate of transfer of residence from one municipality to another, and a declaration of formation of a new family unit with zero income, a circumstance which would have led to a damage for the Ministry of Justice, given that thanks to the practice it would have obtained the remission of the debt. In the provision, the investigating judge ordered the preventive seizure aimed at the confiscation of assets for over 200,000 euros.
