Agrigento prosecutor: government cannot decide on migrant corpses.

The article discusses the legal implications of the transfer of eleven bodies recovered at sea by the Geo Barents ship of MSF to Lampedusa. The prosecutor of Agrigento, Giovanni Di Leo, highlights the multiple issues of a normative, humanitarian, and constitutional nature related to the rescue at sea in light of another immigration tragedy. Di Leo emphasizes that decisions regarding the application of criminal law, necessary investigations, and jurisdiction should be based on the law itself rather than discretionary decisions of political-administrative authorities. He questions the jurisdiction and competence over the case, as the bodies recovered in international waters could fall under the jurisdiction of Agrigento due to the crime of aiding illegal immigration. Di Leo also raises concerns about the handling of the bodies in Lampedusa and questions the choice to disembark them there instead of in a better-equipped port like Porto Empedocle. He concludes by reiterating that legal matters should be determined by the law and not by discretionary decisions of authorities.
