The third civil section of the Court of Appeals of Palermo has ruled for a total compensation of approximately 1.86 million euros in favor of the family members of a young worker, Claudio Ingoglia, who died on February 6, 2008, at the age of 18, in a workplace accident at a quarry in the territory of Campobello di Mazara, known as the Cave di Cusa.
In the verdict, it is emphasized that the investigations carried out by the Prosecutor’s Office of Marsala determined that “the fatal accident was caused by the negligent management of workplace safety at the construction site by both the company Euro Costruzioni, as the deceased worker’s employer, and the architect Ditta, as the designer and project manager on behalf of the Municipality of Campobello di Mazara.”
The Court of Appeals of Palermo has ordered Euro Costruzioni, Luigi Patti, Alberto Ditta, Bartolomeo Castiglione, and the Municipality of Campobello di Mazara to jointly compensate for the damages, which were quantified as 362,847 euros for Rosa Rizzo, the deceased worker’s partner, 343,234 euros for Ingoglia Francesco (son), 235,360 euros each for the brothers Marco and Riccardo Ingoglia, and 343,234 euros each for the parents Giuseppina Spagnolo and Francesco Ingoglia, in addition to legal interests and monetary adjustment.
